These Terms of Use ("Terms") govern your access to and use of the Pokerfolio mobile application ("App"), developed and operated by Pokerfolio ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

Pokerfolio is a poker hand tracking, analysis, and coaching application. It allows users to log poker hands, receive AI-powered analysis, manage bankroll information, and interact with a social community of players. The App is intended for educational and entertainment purposes only.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. The App does not involve real-money gambling or wagering.

4. User Accounts

To access certain features, you must create an account using Google Sign-In (OAuth). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Subscriptions and In-App Purchases

• Free Tier: Basic features are available at no cost, with limited analysis tokens.
• Paid Subscriptions: Premium features (Silver, Gold, Platinum tiers) are available as auto-renewable subscriptions. Pricing is displayed in the App before purchase.
• Gem Packs: One-time purchases of in-app currency ("Gems") are available for additional analysis tokens.
• Payment: All payments are processed by Apple (App Store) or Google (Play Store). By subscribing, you agree to the respective platform's payment terms.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your device's account settings.
• Refunds: Refund requests are handled by Apple or Google per their respective refund policies.
• Restore Purchases: You can restore previous purchases at any time using the "Restore Purchases" option in the App.

6. User-Generated Content

You retain ownership of the content you create within the App (hand histories, notes, etc.). By sharing content through the App's social features, you grant us a non-exclusive, worldwide license to display and distribute that content within the App's community.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Share offensive, abusive, or inappropriate content.
• Attempt to reverse-engineer, hack, or exploit the App.
• Use automated systems or bots to interact with the App.
• Interfere with or disrupt the App's operation.

8. AI-Powered Features

The App uses artificial intelligence (Google Gemini) to provide hand analysis and coaching advice. AI-generated content is for informational and educational purposes only and should not be considered professional financial or gambling advice. We do not guarantee the accuracy or completeness of AI-generated analysis.

9. Intellectual Property

All intellectual property rights in the App, including its design, code, graphics, and branding, are owned by Pokerfolio. You may not copy, modify, distribute, or create derivative works based on the App.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, Pokerfolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

13. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. You may delete your account at any time through the App's settings.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes by posting an update within the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
